1. Acceptance and operator
The Earthfall-related web pages are published under the MKDEV name by its South African developer (“MKDEV”, “we”, “us”, or “our”). By accessing these pages, you agree to these Terms of Use. If you do not agree, do not use the pages.
These terms govern website access and content. The Earthfall Terms of Service separately govern gameplay, guest profiles, multiplayer, ads, and purchases. The Privacy Policy explains information handling.
2. Children and supervision
Earthfall is intended for players aged 3 and older. A parent or guardian should supervise a child’s browsing, game use, online features, and any purchase. The current game does not verify age or provide an in-game parental-consent flow.
3. Permitted use
You may browse these pages for personal, lawful, non-commercial use. You must not misuse them, interfere with their operation, attempt unauthorised access, introduce malicious code, or use automated requests that impair the service.
We may change, suspend, or remove website content or access at any time. We do not guarantee uninterrupted access, error-free content, or that every page will remain available.
4. Website content and intellectual property
Unless a page says otherwise, the Earthfall and MKDEV names, artwork, text, logos, and other content are owned by or licensed to MKDEV. You may not copy, modify, redistribute, commercially exploit, or create derivative works from protected content without permission, except where applicable law permits.
Third-party names, software, images, or services remain the property of their respective owners and may be governed by separate terms.
5. External links and third-party services
Pages may link to or load resources from third parties, including Cloudflare, Google, Google Play, or external font and image hosts. These providers operate independently and have their own terms and privacy practices. A link does not mean we endorse every third-party service or control its content.
6. Privacy
Use of Earthfall and related pages is also subject to the Privacy Policy. The browser game may use local storage for settings, progress, and guest-profile identity. Cloudflare and Google may process information when you use online game or advertising features.
7. Disclaimers and liability
Website content is provided for general information and entertainment. To the fullest extent permitted by law, we make no warranty that pages will be uninterrupted, complete, or free from error. Nothing here removes a consumer right or liability that applicable law does not allow us to exclude.
To the fullest extent permitted by law, MKDEV is not liable for indirect or consequential loss arising from use of these pages. Where a lawful limit applies, total liability for a claim will not exceed the amount you paid directly to MKDEV for the affected website service in the 12 months before the event giving rise to the claim.
8. Governing law
These Terms of Use are governed by the laws of South Africa, subject to any mandatory consumer protections that apply where you live. Disputes are subject to the competent courts of South Africa unless applicable law allows or requires another forum.
9. Changes and contact
We may update these terms by posting a revised version on this page and changing the “Last updated” date. Continued use after the new terms take effect means you accept them, subject to any consent required by law.
