1. Agreement and operator
Earthfall is published under the MKDEV name by its South African developer (“MKDEV”, “we”, “us”, or “our”). These Terms of Service govern access to the Earthfall game and online services. By playing, you agree to these terms. If you do not agree, do not use the service.
Earthfall is intended for players aged 3 and older. A parent or legal guardian must review and accept these terms for a child, supervise the child’s use, and authorise any online features or purchase. The current game does not verify age or record guardian consent in-app.
2. The game and online features
Earthfall includes local gameplay and optional online features such as guest profiles, Cloud Save recovery, matchmaking, invitations, and leaderboards. Online features require an internet connection and may be unavailable, changed, or discontinued. We do not guarantee uninterrupted access or preservation of every online record.
Guest profiles do not require an email address or Google account. A generated player identity can be stored on your device. If you create a recovery code, keep it private: anyone who has it may be able to restore that profile. We are not responsible for access caused by sharing or losing a recovery code.
You can delete your Cloud Save profile from the Cloud Save screen. Deletion removes the online profile, recovery code, cloud campaign progress, leaderboard statistics, and outstanding invitations; local game progress on the current device remains. Finish any active online match before deleting. If the in-game action fails, contact mkdev4360@gmail.com. Clearing local device data alone does not delete an online profile.
3. Player conduct
You agree not to use Earthfall to harass, threaten, impersonate, cheat, disrupt the service, interfere with another player’s access, probe or bypass security, or use automated tools to access the service without permission.
Choose a display name that is lawful and respectful and does not reveal personal or sensitive information. Display names and leaderboard results may be visible to other players. We may remove a name, restrict an online feature, or suspend access when reasonably needed to protect players or the service.
4. Ads, virtual items, and purchases
The Android app may display app-open, banner, interstitial, or rewarded ads through Google AdMob. A rewarded ad may offer an in-game benefit. Ad availability and rewards can change and are subject to Google’s service and consent settings.
Android in-app purchases are made through Google Play. The price and item are shown before purchase; Google Play processes the transaction and its terms, payment rules, and refund procedures apply alongside applicable law. A parent or guardian must authorise a child’s purchase. Do not let a child make a purchase without that authorisation.
Virtual items, shards, upgrades, and ability uses are licensed for use in Earthfall, not sold as property. They have no cash value, cannot be redeemed for money, and may not be transferred between players, except where applicable law requires otherwise. We may balance, modify, or discontinue virtual items as part of maintaining the game.
5. Ownership and limited licence
Earthfall’s game code, name, artwork, audio, design, and other materials are owned by or licensed to MKDEV and are protected by applicable intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to play the game for private, non-commercial use, subject to these terms.
You retain any rights you have in a display name you choose. You allow us to display that name and associated game results as needed to provide online features. Do not submit material you do not have the right to use.
6. Third-party services
Earthfall relies on services provided by Cloudflare and Google, including Cloudflare multiplayer infrastructure, Google AdMob, and Google Play purchases. Their services are governed by their own terms and privacy policies. We are not responsible for services controlled by those providers.
7. Suspension and termination
You may stop using Earthfall at any time. We may suspend or limit access if necessary to protect players, comply with law, address abuse, or maintain the service. Where practical, we will provide a reason and an opportunity to resolve the issue. Sections that by their nature should continue, including ownership, disclaimers, and liability limits, remain effective after use ends.
8. Service disclaimers and liability
Earthfall is provided on an “as available” basis, subject to consumer and other mandatory rights that cannot lawfully be excluded. We do not promise that the game will always be error-free, available, or compatible with every device.
To the fullest extent permitted by law, MKDEV is not liable for indirect or consequential losses arising from use of the game. Nothing in these terms excludes liability that applicable law does not allow us to exclude or limits consumer rights that cannot be waived. Where a lawful limit applies, our total liability for a claim will not exceed the amount you paid directly to us for Earthfall in the 12 months before the event giving rise to the claim.
9. Governing law
These terms are governed by the laws of South Africa, without removing any mandatory consumer protections that apply where you live. Disputes are subject to the competent courts of South Africa, unless applicable law gives you the right to bring a claim elsewhere.
10. Changes and contact
We may update these terms when the game, law, or providers change. The revised terms will be posted here with a new “Last updated” date. If a change materially affects players, we will take reasonable steps to provide notice. Continued use after the effective date means the revised terms apply, subject to any consent required by law.
